SMS for the Estate Agent - Targeted Marketing Tool, or Legal Minefield?

By Ken Norbury Imagine having at your disposal a means to immediately inform house buyers that you have just the property they are looking for. Potential buyers have given their details and their preferences - imagine that you can send them this information no matter where they are or what they are doing, they can read it at a time thats convenient and can act accordingly in their own time. Imagine that you can do this quickly and easily, in a matter of minutes, regardless of the number of recipients. Sounds too good to be true? Well it's not - it's available now, it's inexpensive and you can be taking advantage of it within minutes of reading this article. It's called SMS Text Messaging - and of course you already knew about it didn't you? From the homebuyer's perspective, SMS is a really convenient way to get information. It's personal and it's discreet. There's immediacy about the message, but at the same time it's not intrusive, and they can handle the response at their convenience. So you decide that this is a great idea and you want to get your company geared up for the 21st century. How do you get started? Perhaps your first thought is to get your friendly IT Consultant to take a look at the problem, right? Stop! Don't pick up that phone until you've read the rest of this article. In common with many of these kinds of issues it's easy to get so bogged down in the technicalities that we fail to consider some of the other issues involved. First of all, let's look at the legalities. By 31st October 2003, all member states of the European Union will be implementing Article 13 of the Directive on Privacy and Electronic Communications (DPEC).A public consultation on how to implement the DPEC in the UK was launched by the DTI on 27 March 2003, and ran for 12 weeks, closing on 19 June 2003. Final implementing Regulations are now being prepared, taking into account the responses received. The DTI intend to publish details of these final measures by mid-September 2003. The new Directive: Replaces existing definitions for telecommunications services and networks with new definitions for electronic communications and services to ensure technological neutrality and clarify the position of e-mail and use of the internet; Enables the provision of value added services based on location and traffic data, subject to the consent of subscribers (for example, location based advertising to mobile phone users); Removes the possibility for a subscriber to be charged for exercising the right not to appear in public directories; Introduces new information and consent requirements on entries in publicly available directories, including a requirement that subscribers are informed of all the usage possibilities of publicly available directories - e.g. reverse searching from a telephone number in order to obtain a name and address; Extends controls on unsolicited direct marketing to all forms of electronic communications including unsolicited commercial e-mail (UCE or Spam) and SMS to mobile telephones; UCE and SMS will be subject to a prior consent requirement, so the receiver is required to agree to it in advance, except in the context of an existing customer relationship, where companies may continue to email or SMS on an 'opt-out' basis; Clarifies that the Directive does not prevent Member States from introducing provisions on the retention of traffic and location data for law enforcement purposes; Introduces controls on the use of cookies on websites. Cookies and similar tracking devices will be subject to a new transparency requirement - anyone that employs these kinds of devices must provide information on them and allow subscribers or users to refuse to accept them if they wish. So what does that mean to the potential implementation of your SMS service? Well, it seems quite clear, we must obtain the recipient's permission before sending any SMS messages "unless there is an existing customer relationship". The exact meaning of "existing customer relationship" is however somewhat of a grey area in the act. For example, if it is interpreted as being someone who has at some time bought a product from the vendor, would that mean that the product being marketed would need to be the same type of product? If this were the case, a supermarket would only be able to send messages about a single line of product to people who have bought that product and would not be able to send messages about other merchandise or services. The DTI's stance on this is that this particular issue is clearly covered in existing UK legislation under the Data Protection Act 1998:- "These would restrict a business to direct marketing the kind of products the addressee would have reasonably expected it to market at the time they gave or agreed to use of their contact details i.e. a business could market the products available at the time, but not necessarily those of a business that it took over, or a substantively new product range." So, therefore, it would seem that say a large supermarket chain, who got your name and address, phone number and email details whilst you were a customer buying groceries, should not be legally entitled to begin any form of communication with you using information about you gathered in this way if, for example, they were to start selling Insurance services or indeed start up an Estate Agency business? It would seem so. So, in most cases, it would appear that your existing customers are open to you being able to send them SMS messages, as it would be reasonable to assume that they would expect you to send them property related information. There are however other grey areas in the document. The following is an excerpt from the DTI's document on Article 13:- "Grey areas under the current rules include the status of systems which send SMS automatically and power dialler-type systems which dial numbers automatically but are designed to establish a voice link with a live operator rather than a pre-recorded message. Lack of certainty about the application of the TDPP (Telecoms Data Protection Directive) Regulations has made it harder to deal with the problems that these kinds of systems can cause. Power diallers, for instance, can cause problems to subscribers where they are used without enough call centre staff available to answer the calls being dialled, resulting in single or repeated silent calls, or calls which cut off after a few rings, in addition to any annoyance caused if they are used to ring subscribers who have registered on the TPS (Telephone Preference Service). Limiting the definition of automated calling system does not mean that these areas will be unregulated. The sending of unsolicited SMS for advertising purposes is now explicitly covered by the Privacy Directive which treats them in the same way as e-mail messages." Anyone receiving SMS messages from you should have a clear indication of where the message came from and a clear method to unsubscribe from your service. It would seem therefore that apart from any other considerations, there are many potential legal pitfalls to setting up your own e-marketing system. Looking at this from a slightly different perspective, the solution may well be a lot easier than you might expect. From the consumer's angle, the approach to receiving SMS or email messages about products and services is something each of us would rather have much more personal control over. In 1998, my company at the time, Geoworks Corporation, did some extensive focus group research into consumer reaction to e-marketing and in particular SMS. This research was conducted both here in the UK and in the US. At that time, SMS messaging had been available to mobile phone users for a number of years, but we had not acheived the massive volumes that were to be reached in the phenomenon which took place some 12-18 months later when Pay As You Go services sparked huge SMS growth. To illustrate the point, all of the UK mobile phone companies at this time probably had only one or two SMS Controllers (a computer which handles the storage and routing of SMS messages) in their infrastructure. When the ramp-up suddenly began, the growth caught most of them completely unawares and meant that they had to try and commission new SMSC's faster than the boxes could be ordered! What had been a fairly straight and flat line on a graph suddenly went vertical. Our research at Geoworks indicated that consumers were excited about receiving SMS messages about products or services provided that they were not being charged to receive the message and they had some control over what products and services they were going to receive messages about. "Permission Marketing" was the key - what the consumer wants, when they want it and where they want it. Consumers indicated that they would be happy to receive all kinds of information supported by advertising on the same basis - for example, Weather Information sponsored by X or Football Scores sponsored by Y. It would seem then, that the key to success in this area is not in the hands of the vendor's innovations or exclusive products, but in giving the consumer control. Without permission, any attempt to sell via this means becomes annoying and intrusive, causing the would-be potential buyer to become alienated against the marketer - a self-defeating exercise if ever there was! So what should be your way forward? Look at other e-marketing success stories for a clue. Amazon.com is, today, a well known and respected seller of books and much more which started from humble roots in the Seattle area and has grown to be a worldwide $multi-million success. Amazon's success was based on giving you, the consumer, control and providing a top-class next-day service. You control from the comfort of your home or office, the parameters that determine what you get from Amazon. It's easy and convenient, and grew like topsy. Ebay is another example - providing a worldwide auction service. Many other services provide 'Portal' access for the consumer to select what information they wish to receive. So it seems Portal services are the key to gaining the hearts and minds of the consumer. But as an Estate Agent, how does that help? A Portal could provide a single access point for would-be housebuyers to register their interest in properties by locale, price and number of bedrooms. The consumer controls what they want to get. It is open to all Estate Agents who can register, quickly and easily, any property that is going on the market. Any technical or legal issues are the responsibility of the Portal and not of the individual Estate Agent. From the consumer perspective, its one place to go, they register once, but potentially get messages from many Estate Agencies provided that they match their criteria. The good news: the duration of adolescence is up to the patient. A patient only hurts themselves when they break the rules. Successful WLS patients commit to themselves early to be in control of their own gastric bypass growth cycle. Maturity At maturity a patient understands the gastric bypass system and is living the life they dreamed. They have achieved desired weight loss and maintaining a healthy weight and have stopped fighting the gastric bypass. I believe WLS maturity is reached when patients understand one word: respect. Respect for the tiny tummy, respect for the science of the body, and respect for oneself. Sure, we all experience an occasional lapse of judgment; that old lover of ours food - is flaunting temptations every single day. But the gastric bypass patient is a brave and resilient person. Successful patients build on infant and teenage experiences and become an adult embracing all the good things gastric bypass has facilitated. The battle against obesity isnt easy and it never ends. Of course, you can call on the help of a wedding planner who will orchestrate the event for you. Some will work within your budget and others charge a fortune. Services include finding a venue and sourcing suppliers such as photographers, florists and cars. They will often take the strain on the actual day by liaising with suppliers, guests and the venue. If you opt to organise the event yourself, here are some tips for what you need to think about in the build up to the big day. Getting started Tell your friends and family about your news, maybe put an announcement in the press and start to think about whether you want a best man or woman - it's nice to ask them when you tell them your news. On the financial front, you need to think about setting a budget. The average wedding last year cost 17,000. You can hold a wedding for a few thousand or really push the boat out but you need to decide how much you want to spend early on. It is a good idea to open a wedding bank account so you can start saving towards the big day. Once you start shelling out money, you should consider taking out wedding insurance. This will cover a wide range of eventualities. The top five claims are wedding attire damaged, having to re-take the wedding photos, cancellation of the wedding due to an illness or bereavement, caterers not turning up and loss of wedding rings. The next important step is to decide on a date and find a venue. As some wedding venues and suppliers get booked up a year in advance you may need to be flexible on dates or start planning at least a year in advance. You also need to find out policies on cancellation and minimum numbers. At least six months in advance you should book your transport, photographer, videographer, florist, musicians, entertainers, toastmasters and order stationery. You need to check that any suppliers have the necessary public liability insurance. Make sure you arm yourself with a list of questions before you discuss your arrangements, for example, do you want a theme or a particular colour scheme. This could follow through from your invitations to your flowers, to your attire and table decorations. At least four months before the big day, you should start any fitness regime, if you are concerned about fitting into your outfits or you just want to look radiant on the day. You also need to purchase wedding rings, order your wedding cake, choose a gift list company, make a draft of the invitation list and organise your outfits. You should send out invitations, including accommodation options and gift list information. Many of the big stores such as Selfridges, Debenhams and Argos have gift list services. You tell them what you would like on the list and people can ring up or sometimes search online to choose what they want to give you. You could also select a charity for people to donate to instead of gifts. If you want to give people wedding favours - little gifts for them to take away, you should either order these or start making them. There are online stores that specialise in gay themed favours. Two months before the big day, finalise your honeymoon arrangements, book any vaccinations you might need if you are going somewhere exotic and organise your going away outfit. You should write any personalised wedding vows and book a rehearsal with the registrar. You need to print order of service sheets and contact local or national newspapers to announce your civil partnership ceremony. In the final month, chase up any unanswered invitations and draw up a list and seating plan if you are having a formal sit down meal. Write out place cards. Confirm final numbers with your venue and caterers. Double check with all your suppliers that everything is booked. Make hair appointments for the morning of your big day. Organise any pre-wedding party you might want - the equivalent of stag or hen nights. Book your travellers cheques or foreign currency if you are going abroad for your honeymoon. Type up a list of shots you want your photographer to take. The day before, you might want to arrange for your honeymoon luggage to be delivered to the hotel if you are staying overnight. Have any pampering treatments you need. Make sure the rings are ready, that someone is picking up flowers for any buttonholes and have a good meal to sustain you through the next day. Try to relax! She caught bream and perch. On the bigger fish I had to help her reel the fish into our possession. She was not afraid of the dark and barely blinked an eye at the approach of the snakes that inhabited the waters. I tried to keep the snake population to a minimum because of the fact that children played and fished in proximity to the pond. When I fired at a copperhead that was swimming scant feet away from her, her only comment was whether I had connected or not. She has grown into other activities. Baton and baseball fill her days. How to Grow Asparagus

By Terry Blackburn Asparagus is a perennial; I think it is an acquired taste but many would disagree believing it to a delicacy and this is reflected in the price of shop bought spears. Therefore if you like asparagus this is precisely why it is well worth growing. To grow this vegetable it does require special treatment and a little patience. Since it is to remain in the same spot for many years, the ground must be well prepared before planting. Soil Preparation Asparagus requires a sandy loam as this soil warms up quickly in the spring because of their low moisture content. This will stimulate the plant into growth, so that the asparagus sticks can be cut early. It requires some protection against cold northeast winds; erecting some type of barrier either permanent or otherwise will protect the plants and give them shelter. Prepare the ground by digging to a spade's depth in the autumn and adding well-rotted compost and manure at the rate of a large bucketful to the sq. yd leave the soil rough over winter. In late March begin by forking over the soil 3 or 4 in. (76mm-101mm) deep. Apply fish manure with a 6 per cent potash fertilizer at 4 oz. (120g) to the sq. yd. This dressing is appropriate each spring until the asparagus bed is exhausted, which could be up to 20 years or more. Top dress each October with well-rotted compost and manure. The intended asparagus bed must be completely free of weeds. Planting Asparagus roots are thick and succulent but dry out quickly. Therefore, when you buy your plants soak them in water for a day and then put them out into the garden covered in damp sacks, taking great care not to expose the roots to the air more than is necessary. You can buy asparagus crowns (root clumps), which are one, two or three years old; naturally the one-year-old crowns are cheapest. Planting should take place during late March early April, just as soon as the soil is dry and friable; never plant when it is wet and the soil sticky. Cut out trenches 6 in. (15cm) deep and 6 in. wide, 3 ft. (90cm) apart. Remove the plants from their damp sacks and plant them 2- ft. (75cm) apart, as quickly as possible so that they do not dry. Place them into the bottom of the trenches, spreading the roots out carefully so that they radiate evenly all round the crowns. Cover them with 3 in. (76mm) of good soil, firming this with the back of your spade. The trench should be filled up gradually during the summer as the plant grows; by October the ground should be level. The roots need to become established in the first year, during the second year let the fern grow well so that good crowns are built up for these will produce good shoots early the following season. General Care Keep down the weeds, this is extremely important for the asparagus does not itself produce any weed-smothering foliage. By November, the fern will have died back, they should not be cut back until then, as the plants need their ferny leaves with which to store up energy for the following year. Any foliage that remains at this time can be then trimmed to tidy the bed, leaving an inch or so above ground level. Top dressings of fertilizers and manures can be given each year at this time. Harvesting Allow the plant to establish and gain in size before the spears are harvested. Wait until the plants are in their third year before taking the spears; then they can be cut when they are about 4-6 in. (101mm-152mm) high. Cut them below the soil surface, down to 2 or 3 in. (50mm-76mm) using a long narrow knife or a special asparagus knife, which has a serrated edge. Take great care not to damage the crown. Spears can be cut every two days in the early part of the season, around May time. The season is relatively short, cutting should stop at the end of June, and the remaining shoot should then be allowed to go on to produce asparagus fern. The fern itself should be cut down to within 6 in.(15cm) of the soil level just before the berries ripen; this will then prevent the ripened fruits falling to the ground, scattering useless seeds because the aim it to cultivate only the chosen "pedigree" crowns. Child Care - What to Look For

By Michael Russell Trying to find good quality daycare is very hard. One should start early. Starting six months earlier than you need daycare is not too long, because when you find the daycare that meets all your needs and your child's needs, there will probably be a waiting list. Also, it takes time to visit the centers, interview the care givers and do the "kid test". There are some things you need to think about first. Do you want childcare closer to home or work? Are you looking for child care centers or in home day care? Centers may have more children, but they are most likely to be accredited. Centers also have to meet state guidelines. At home providers may have fewer children and an "at home" feel but they are not always required to meet certain state guidelines. You should do your research. Ask around and get a feel on what other parents think. There is nothing better than word of mouth. You could check references given to you by the providers and you should, but are they going to give you references that are going to say bad things about them? Talk to parents whose kids go to that provider. Try to find parents who used to take their children there. Be specific. Don't just ask if they liked it, ask them why they did or didn't. You can also call you local child care resources and referral center. They can you give state guidelines on childcare and they can give you a list of providers in your area. Make sure you ask them what the requirements are for licensing. They can also give you a list of complaints and violations. After you narrowed down a list of providers you need to visit and ask a lot of questions. Sure you can do this by phone but you need to get a feel of the center while you're there. By the time you visit, you should know the child to adult ratios that the care givers need to follow, so look around, are there more children than providers that are required by law? Another thing to consider is group size. There is a group of 25 two year olds with five adults and a group of 10 two year olds with 2 adults. Both of these groups are within the proper child to adult ratio, but which one may be calmer? Look around. Do you see smoke detectors, more than one exit, fire extinguishers, outlet covers? You can acquire a checklist of all things to look for from the child care resource and referral program. Check the care givers' qualifications. Inquire about training and education. Do they know first aid? Do the caregivers attempt to continue to educate themselves by going to workshops? Try to see if there is a high turnover rate. Children need consistency. You don't want them going through more than one caregiver a year. Check to see if the center has any accreditations. Centers have to meet certain state guidelines, but did they voluntarily go above and beyond that and get nationally accredited? Don't forget to do the "kid test". Bring your child to the provider and see how they react. Will there be a good relationship with your child and the providers and the other children. You should bring them a few times so they can get a feel for the place. Look for your child's reactions. Trust your gut. It will take time but it will be worth it knowing your child is safe and happy.
