Status of Punitive Damage Law
By Patrick Madden RECENT CASE LAW AFFECTING PUNITIVE DAMAGES A series of recent United States Supreme Court decisions have defined the standard for imposition of punitive damages. In State Farm Mutual Insurance Company v. Campbell, 538 U.S. 408 (2003), the Supreme Court applied the guidepost it had previously established in BMW of North America, Inc. v. Gore, 517 U.S. 559 (1996). The Gore decision directed appellate courts reviewing punitive damages awards to consider the following three factors: (1) the degree of reprehensibility of the defendants misconduct; (2) the relationship between the actual and potential harm suffered by the plaintiff and the punitive damages award; and (3) the difference between the punitive damages awarded by the jury and the civil penalties authorized or imposed in comparable cases. In State Farm, the Supreme Court emphasized that, of the three Gore factors, the single most important indicator of the reasonableness of the punitive damage award is the degree of reprehensibility of the defendants conduct. The Supreme Court then applied the five factors it had previously set forth in Gore to measure the reprehensibility of the defendants conduct: whether the harm was physical or economic; whether the tortuous conduct evinced an indifference to or reckless disregard for the health or safety of others; whether the conduct involved repeated actions or was an isolated incident; and whether the harm resulted from intentional malice, trickery, or deceit, or mere accident. The United States Supreme Court heard oral arguments in Phillip Morris v. Williams, Number 05-1256, on October 31, 2006. In Phillip Morris, the Supreme Court will, for the first time, be asked to apply the Gore guideposts to a case involving the death of a plaintiff - a long time smoker who died of lung cancer - rather than a case of merely economic damages. In Phillip Morris, the Oregon Supreme Court upheld the punitive damage award to the family of a deceased smoker more than one hundred times the amount of actual damages. Phillip Morris appeal presents two questions to the court: (1) whether, in reviewing a jurys award of punitive damages, an appellate courts conclusion that a defendants conduct was highly reprehensible and analogous to crime can override the Constitutions requirement that punitive damages be reasonably related to the harm to the plaintiff; and (2) whether due process permits a jury to punish the defendant for the effect of its conduct on non-parties. DEFENDING A COMPANY IN PUNITIVE DAMAGES CASE Punitive damages often represent a significant, if not the most significant, exposure a company faces in litigation. Dealing with punitive damages must be part of a bigger litigation strategy. It is critical that a company, in conjunction with trial counsel, prepare a comprehensive plan of action to avoid, or minimize, the companys exposure to punitive damages. The plan of action should include discovery and witness selection intended to demonstrate the difference between any mistakes which were made, and conduct which was intended to cause harm. At trial, effort must be made to select jurors who will rationally analyze the evidence, rather than base their findings exclusively on anger or sympathy, to allow a chance for a positive outcome for the company. INSURABILITY OF PUNITIVE DAMAGES There is currently no clear guidance from either the Texas Legislature or the Texas Supreme Court on the issue of whether Texas public policy prohibits a liability insurance provider from indemnifying an award for punitive damages imposed on its insured because of gross negligence. Texas appellate courts have long wrestled with the issue, and have reached different conclusions. Some courts have found that parties should be allowed to enter into contracts freely, and ensure that the insurers comply with their contractual obligations. See Am. Intern. Specialty Ins. Co. v. Triton Energy, Ltd., 52 SW.3d 337 (Tex. App. - Dallas, 2001). Other court have found that insuring punitive damages violates public policy, as it defeats the purpose of awarding punitive damages (to punish the wrongdoer and to deter similar behavior in the future), by permitting the wrongdoer to shift the burden of paying the punitive damages to its insurer. See Milligan v. State Farm Mut. Auto. Ins. Co., 940 SW.2d 228 (Tex. App. - Houston, 1997). The Texas Supreme Court has thus far refused to address the issue of whether punitive damages are insurable. However, the Fifth Circuit Court of Appeals has certified questions concerning punitive damage awards to the Supreme Court of Texas, in a case filed in August 2004, which is currently pending before the Texas Supreme Court. Religion and Social Engineering - Part of an Introduction

We must ask them to justify their laws and their acts and insist on leadership that is truthful and righteous. That is not to say there is such a thing as black and white absolute truth or some way man can actually limit the awesome reality of the creative potential of life energy on earth and in universe. I can hardly accept that John Calvin is anything more than a power-broker when I see or read him saying we should not question authority. Should we merely accept his interpretation of Jesus or any other dogma his ilk has designed to empower themselves over all life and therefore God too. Calvin said, When it is a question of our justification, we have to put away all thinking about the Law and our works, to embrace the mercy of God alone, and to turn our eyes away from ourselves and upon Jesus Christ alone. I do wonder about his Bohemian origins and humanistic liberal attitudes fostered by Prague denizens or alchemists who became the Bavarian Illuminati. Switzerland is the center of Rothschild and Battenberg Royal history for the last thousand years or since the time Rome supposedly fell and Christianity became what it is today. In an age in which the healing of the nations from the ravages of hunger, disease, and war has become the dominant moral imperative, Jesus the Healer has come to assume a central place. It was an emblem of the central place of Jesus {Perhaps for a lot longer than he knows.} when, under the terms of the Geneva Convention of 1864 for the Amelioration of the Condition of the Wounded and Sick of Armies in the Field, the international organization created to carry out that moral imperative took the name Red Cross Society, its symbol, based on a reversal of the colors of the Swiss flag, is a red cross on a white background. Yet the connection between evangelization in the name of Jesus and the mission of help and healing has also been an issue for debate, especially in the twentieth century. This debate, too, comes as a commentary on the literal meaning of a word in the Gospels: Whosoever shall give you a cup of water to drink in my name, because ye belong to Christ, verily I say unto you, he shall not lose his reward. {Biblio: Mark 9.41} It has almost seemed that in every epoch there were some who were primarily interested in naming the name of Christ, clarifying its doctrinal and theological meaning, and defending that meaning against its enemiesbut who named the name without giving the cup of water. Yet it has seemed possible for others to give the cup of water, to provide the healing, and to improve the social lot of the disadvantaged {Yes, and they are the ones who created the disadvantageous divisions and castes in society to begin with.}but to do so without explicitly naming the name of Christ. Does that saying of Jesus mean that each of these ways of responding to his summons is only a partial obedience to this dual command? In the answer to this question, much of the debate over the primary responsibility of Christs disciples in the modern world has concentrated on the disjunction between the two components of the imperative. (1) Yes, there is jargon and code or esoteric meaning in this which even he does not know in the fullest depth I think. It is not unlike the talk about manifesting the god force which became a political agenda around the time of the Hyksos or Semites in Egypt. Some say Alexander was the first to claim divinity while living and I imagine he did it more than those before him. All these people were propagandists selling people on their greater importance rather than helping people see the divinity in all things which many earlier people had included in their knowledge that gods were mere representations of the forces of nature. Tuthmosis III may have been the same character who re-organized the Mystery Schools which Gardner writes is the foundation of his Great White Brotherhood. I am pretty sure from my extensive research that Amun was a one god concept of a supreme connected or collective of the forces of nature going back to before the Sphinx which was both gendered and honored Amun and Amun-Ra the Heliopolitan or Harmonic of Light which I dealt with in great detail in Neolithic Libraries. I also think the House of Mallia or Milesians included this Tuthmosis character and the other Tuthmosides as well. Here is a top scholar from Egyptology writing about this Tuthmosis character and his so-called manifesting god in the first recorded instance. The first reference to the divine will being manifested is probably that made by King Tuthmosis III, who relates how, when he was still a boy, the god Amun, in the course of a procession of his statue round the temple, noticed him and halted. Tuthmosis prostrated himself on the ground before the god, who thereupon led him to a part of the temple called Station of the King, thereby publically recognizing him as king. In this case the god revealed his will unasked, but from now onwards cases multiply in which the revelation of a gods will was sought for by men. (2) These elites and their Divine Kings are a plague upon life on earth and it is not getting better. The sophistication of the intrigues are not always obvious like it is in Korea today where we have Moonies with Missiles or in Iran where the Ayatollahs run roughshod over soulful enablement. The same thing works in most media controlled environments or the world paradigm in toto. Just because the traditional religions have lost some demographics in terms of having insane or cultish followers does not mean the Mormons, Noahdist extremists and Moslem Jihadists or Scientologists are any different. I like the thought expressed by James Watson in his foreword to Discovering the Brain. He said, The brain boggles the mind.. It is also true that a lot of the boggling has been done by those saying they seek God. We can be so much more if we would DO as Jesus and other desposyni did. There are despots in these groups of the Merovingian or family of Jesus however. We should be trying to end intolerance and the deification of one group while demonizing any others or branding some as heretical points of view. Ultimately all religions and beliefs are struggling with the same thing but those that stop seeking to participate in the creation and thus limit 'What is' are engaged in playing god. They often have made themselves the sole spokesmen for their imaginary god or the Lord as in the case of the Catholic hegemonists. But before we get into the current hegemony too much we will have to understand the root of the problem. The Reformation did not just happen and in some ways it is an academic or superficial construct. Here is Černỷ again as he addresses one of the origin myths thought to be most ancient. Note Heliopolitanism (Druidic sun-worship that Thomas Paine tells us is the basis of Masonry.) seems to be even more ancient. Nevertheless, Djedu was probably not his original home, since the proper god of Djedu was Andjeti, who is represented in human form as a ruler with his insignia, a long crooked sceptre in one hand and a whip in the other, with two feathers on his head. Andjeti was, however, very early absorbed by Osiris and his name became a mere epithet of that god. A circumstance that favoured the absorption was that Osiris too was entirely human in form. He also is shown with the Upper Egyptian white crown to which two feathers are attached on both sides and which is set on a pair of rams horns. But there is an important difference between Andjeti and Osiris: while the former represents a living ruler, Osiris is always shown as a dead person, standing, wrapped in a long white royal cloak, the two arms holding the sceptre. His name Usire, of which Osiris is the Greek form, seems to mean Seat of the Eye; it has the appearance of a human name and it is probable that Osiris was originally a human king {How long ago?} who became deified after his death. A myth was woven around his person which is less concerned with his former life and rule as a king of Egypt than with his death and subsequent resurrection after which he became a ruler in the realm of the dead. No systematic expression of this myth is known from Egyptian sources, our chief authority in this respect being Plutarch in his On Isis and Osiris; frequent allusions, however, occur in Egyptian texts of all periods which show that Plutarchs account agrees essentially with the Egyptian belief. (3) In May 2004 there is a report of an archaeological find in Mayan tunnels (they loved the spiritual cenotes and still do) saying it was a millennium earlier than the Mayan ascendancy and yet it was just 200 BC. Aside from the fact that I have proven these people were there at least 3000 years earlier the find is a mask of a sun god. The sun god or Heliopolitan Druidism is just one of the esoteric clues to follow in tracing the travelers or Red-Headed League of Megalith Builders all over the world. When Viktor E. Frankl faced death in a concentration camp he learned a great deal about meaning and life. Most people live in fear and this debilitating fear of death is not healthy. He developed a whole school of psychology called Logotherapy from facing the choice of dying. But there is much more to learn from the Many Worlds Interpretation of Physics and from ancient shamanic travels to the places the soul goes at death and potentially before death. His experiences there must have included altered states that can be brought about through fasting and trauma. His work in that area is not particularly enlightening even though his Logos or Meaning is akin to the LOGOS which is the beginning (as in the Word) and harmonically attuned to the akashic record which might be in our genes or the Cosmic Soup or both. What I term the existential vacuum constitutes a challenge to psychiatry today. Ever more patients complain of a feeling of emptiness and meaninglessness, which seems to me to derive from two facts. Unlike an animal, man is not told by instincts what he must do. And unlike man in former times, he is no longer told by traditions what he should do. Often he does not even know what he basically wishes to do. Instead, either he wishes to do what other people do (conformism), or he does what other people wish him to do (totalitarianism). (4) Why have those who arranged these horrors tried to blame the Jews (and in an indirect manner, all 'sinners') for the death of Jesus? He did not claim to be a co-equal member of the Holy Trinity. It wasn't the Jews who 'killed our Saviour'. This untenable contradiction between the assertion of monotheism and the reality of polytheism was dealt with {And this is the MOST important observation of a technique known in psychology as 'projection of a pluperfect paranoid' or the 'BIG LIE' of alphabet soup agencies and 'black ops'; the less organized criminals like the Mafia call it a 'frame-up'.} by accusing other religions of the Christian fault. The Church - Catholic and later Protestant - turned aggressively on the two most clearly monotheistic religions in view {Also they began at least 700 years of war, A CRUSADE! against the remnants of the Kelts in Ireland.) - Judaism and Islam - and persecuted them as heathen or pagan. ..These pagans must therefore be converted, conquered {ego 'Manifest Destiny'} and/or killed for their own good in order that they may benefit from the singularity of the Holy Trinity, plus appendages. HOLY TRINITY - POST CHRISTIAN So far Nietzsche has been wrong about GOD. We have not managed to become Him in His place. Instead we have replaced God with a yet more abstract divinity based upon pure rational power... Organization or structure replaced the Father, TECHNOLOGY displaced the Son and the Holy Ghost gave way to information. The new priesthood was made up of technocrats. By Jaci Rae In order to Win MVP, you must learn to be confident. Learn to be comfortable in your own skin without being cocky or arrogant. Learn to communicate in deeper ways with your partner. If you already have deep relationships with other friends, use the same principals to obtain that same kind of intimacy with your loved one. If you don't have deep relationships with other people in your life, learn how to do so. Take a communication class and read books on the subject, occasionally practicing in the mirror to feel more comfortable with communication. I know this may sound a little silly to you, but trust me, I have had many of my male and female friends use this technique to build their confidence. Put little notes to yourself on your fridge, on your mirrors, in your car, on your computer, etc., that has positive affirmations about yourself. Even if you don't believe the statements yet, you will come to do so over time if you say them every time you pass by them. Use statements like: "I am a great communicator;" "I can succeed at learning to build a deeper relationship;" or "I am a valuable person on the playing field of love." Learn to kiss the man or woman in your life so it will knock his / her socks off, but don't move to the next level. Learn to enjoy kissing for hours, just as you did before you became physically intimate. It will deepen your relationship. Learn what your partners secret dreams and desires are by asking and listening carefully. Then try to help him / her achieve some of those dreams and desires. Make a habit of complimenting your partner at least once a day. If you have the chance to see your partner or talk to them, you can use that time to compliment them and do it often. Be consistent and reliable in what you say and do. This will go a long way toward building trust with your partner, something he / she may never have experienced with other men or women. Mosquito Spraying: Is It Dangerous For You Health?
By Raul Gallu Mosquito spraying is one of the most commonly used methods to stop the breeding of these nasty insects. Due to the fact that there are chemicals that are spread over areas where people live, mosquito spraying raises a lot of question like : are those pesticides safe for my health? Does it affects my pets ? What about the objects left outside are they affected by mosquito spraying? And so on. In this article we will try to answer to some of these questions.
Mosquito spraying is done using mounted fogging units to apply insecticides as an ultra-low-volume (ULV) spray. These units spray units dispense very fine aerosol droplets (fog) that stay aloft and kill mosquitoes on contact. The amount of insecticide used in mosquito spraying is small compared to the area treated, usually about 3 to 5 ounces per acre, which minimizes exposure and risks to people and the environment. Mosquito spraying is also done by thermal foggers that use an oil carrier that is heated to disperse the pesticide in a dense smoke-like fog.
During mosquito spraying , flying mosquitoes within the treated area are killed. Although the local mosquito population is reduced for a few days, fogging does not prevent mosquitoes from re-entering the area.
The most commonly used products in mosquito spraying are pyrethrins, synthetic pyrethroid insecticides (such as Scourge and Anvil )and malathion. Pyrethrins are insecticides derived from the extract of chrysanthemum flowers. Pyrethroids are human made forms of pyrethrins. Both of them act as contact poisons, affecting the insects nervous system. For mosquito spraying they are combined with a synergist (such as piperonyl butoxide) that allows the insecticide to be more effective by restricting the enzyme that insects use to detoxify the pyrethrins.
Pyrethrins and pyrethroids are use in mosquito spraying without posing unreasonable risks to human health when applied according to the label although, in high dosage, pyrethroids can affect the nervous system, coughing, wheezing, shortness of breath, chest pain, runny or stuffy nose. Regarding the wild life and the environment these two insecticides do not pose unreasonable risks, also. When used in mosquito spraying they are low in toxicity to mammals, and are practically nontoxic to birds. However they are toxic to fish and to bees. Therefore E.P.A (Environmental Protection Agency) prohibits the mosquito spraying to open water or within 100 feet of lakes, streams, rivers or bays.
Malathion is an organophosphate insecticide that has been registered for the first time in the United States in1956. It is used to kill insects on agricultural crops, on stored products, on golf courses, in home gardens, and in outdoor sites where trees and shrubs are grown at home and also used in mosquito spraying. Malathion comes in two forms: a pure form of a colorless liquid and a technical-grade solution (brownish-yellow liquid), which contains malathion (greater than 90%) and impurities in a solvent. The technical-grade malathion smells like garlic.

rate of 0.23 pounds (or about 2.5 fluid ounces) of active ingredient per acre, so it doesnt pose unreasonable risk to human health. However, at high doses, malathion, like other organophosphates, can overstimulate the nervous system causing nausea, dizziness, or confusion. Severe high-dose poisoning with any organophosphate can cause convulsions, respiratory paralysis, and death. Competitive Ballroom Dancing
By Shannon Martin Competitive Ballroom Dancing is a highly competitive sport that is a lot of fun and great for your fitness. There are competitions happening all over Australia almost every weekend with people from almost ever age group involved. Ballroom Dancing Competitions are held throughout Australia in capital cities and regional centers throughout the year. They are great spectacles of the skill that is involved with Ballroom Dancing. Dancers compete in three styles, over 5 grades in 6 different age groups. This means that whoever you are, no matter experienced you are, there is a competition for you. There are three different styles that couples compete in during Ballroom Dancing competitions, these are Modern Ballroom, Latin American and New Vogue. Latin is the most popular of these forms, especially with the younger couples and is the most fiercely competitive, with many couples only competing in this style. In the different styles there are 5 grades. You begin at level 1 and work your way through to level 5 by winning at different competitions, there is also an Open level where dancers from different levels compete against each other. There are also 6 different age levels for dancers, Juvenile, Junior, Youth, Adult, Masters 1 and Masters 2. All of this means that you are only competing against people of your own age and skill level, in the styles that you want. If you arent sure if competition is your thing, you can start off with individual events where you dance with a more experienced dancer in only one or two dances. Competitive Ballroom Dancers compete in high quality events and because of this they need to be fit and prepared for competitions. Dancers train almost every day and for several hours per session perfecting their routines and techniques, they also have several private lessons with their coaches during the week. A lot of work also goes into their outfits with a lot of time and money being spent of dresses, shoes and outfits as every dancer wants to look their best. Comparative Religion 101 - What They Won't Tell You in That Class
By Michael Bresciani If your view of religion is like most people, you think that religion is a list of dos and donts or a set of rules, laws or other directives that should be guiding your behavior. What is taught in comparative religion courses is based on this simple premise. New Testament Christianity is thrown into this generalized heap usually by people who are not Christians and have no understanding of what Christ stands for. You might say I am making an excuse for them, but I am not. The result of this assumption can produce the greatest loss any man could ever endure. If rules and ordinances are what makes a real religion then New Testament Christianity would barely make it into the list. It has only two outward or ceremonial ordinances and neither of them can produce salvation. They are water baptism and the communion or breaking of bread. What Jesus said was that he came to give men life (John 10:10), not another religion. Thank God he knew we already had enough of them. Here is one of the major differences between Christianity and every religion that came before or after it. When God sent his Son into the world to die for our sins, then resurrect him from the dead he was in effect saying, knock it off! He doesnt require our feeble attempts to placate him with our endless religious hokey pokey. Essentially God was saying, stop trying to please me with those things you dream up and I will show you who I am and exactly what I want. What small child can possibly think of the best way to please his Dad? No child should have to decide what that is; a decent father sets the parameters and makes them known to his children. He already loves them because they are his, why would he require them to perform to make him love them more. That real Christianity is not a religion but a way of life is given more credence by another little known fact. The Bible uses the word religion only five times and only once is it given a definition. That definition (James 1:27) offers no list of dos and donts, no nine fold path, no Mosaic burdens and no stifling ceremonial ordinances. No one could give the New Testament a serious read and say Christ started a new religion. What he started was a way to deal with the our sins, both now and for all eternity. Most religions are like doors that keep men out until they have done the work, performed the rituals, jumped through the hoops, cleaned up their act or something even harder than all that. Jesus who said he was the door (John 10:7) has become the passage into Gods presence both now and for eternity. He requires repentance and then a dedication to Him and his words but, and I do mean but, he never sets up any religious rules, codes, or requirements. There are no ceremonies, liturgies, or imaginary scales in the sky that are there to measure your goods and bads on a daily basis. God said there are no other Gods; he alone made all there is including us. He isnt jealous of other Gods, there arent any other Gods. He revealed himself through the patriarchs and prophets and finally through his Son. The history of man is cluttered with mans feeble and mistaken attempts to create God or a whole pantheistic slew of them from his own imagination or worse, with the help of the God of this world. (Satan) God has provided a clearer and far more approachable path to take the nonsense and guesswork out of it. But alas, mans propensity for religion is second only to his propensity for sin. We would rather build shrines and cathedrals; we would prefer a set of rules and regulations rather than accepting a free gift from God. He offers the gift quite apart from any thing we could dream up; hey thats why it is called a gift. Picture Peter, James and John looking at what most of will never see until the second coming of Christ. Jesus magnificently transfigured before them in a glowing radiance. Instead of standing in awe or quietly gazing and listening perhaps to learn something, instead they decide to build a shrine or a Tabernacle (Mt. 17:4) Jesus doesnt reply to Peter who suggested the tabernacle but God the Father does. In one short reply God sums up the matter of shrines, tabernacles, laws, codes ceremonies, liturgies and all the other religious notions of men. He saidThis is my beloved Son, in whom I am well pleased; hear ye him. Mt. 17:4b That some of the religions that are compared in a comparative religions course are ancient and perhaps predate Christianity is often the argument for their veracity. The Bible says that God winked at mans former idolatries but after he sent his Son, those excuses would no longer stand. That man has held onto religions that do not lead to God for so long is only proof of our penchant for idolatry. Lots of things are ancient, that says nothing about their usefulness. Why should religion be any different? Before Mohammed died he said some truth had been revealed to him. Before Buddha died he exclaimed that he was still searching for the truth. Jesus said quite clearly that he was the truth, John 14:6. The last time I checked the shortest distance between two points was still a straight line. I prefer the straight line when it comes to my entire future dont you. Jesus is the straight line to God and as far as putting him along side others in a comparative religions course, there is little hope of making comparisons with one who sets the definition of incomparable.
